When Roe V Wade was overturned, this exactly what came to mind for me and I wrote on it here. There is absolutely nothing to stop them from overturning Brown vs Board of Education. All it takes is for a well funded conservative think tank to find some reason or some grievances that calls Brown v Board of Education; make it a case and appeal it all the way to the supreme court.

Without it being codified into law, the partisan supreme court can pull the strings on the hard fought rights we enjoy and send us back 70 years. I wonder what the allies would do then.
